CHAPTER I. ADMINISTRATIONCHAPTER I. ADMINISTRATION\ARTICLE 9. REVENUE, BUDGETING, FINANCE AND COMMUNITY DEVELOPMENT

The following are designated as main trafficways of the city pursuant to K.S.A. 12-685 et seq. for purposes of bond financing certain improvements:

(a)   Main Street from the city limits to the city limits within the City of Stafford.

There is hereby levied in the city a tax of two and one-quarter percent on the gross earnings from money, notes and other evidence of debt, commonly known as intangibles, having a situs in the city. Such tax is hereby levied for the year 1982, on the gross earnings from such intangibles in the year 1981, and shall be applicable to such earnings and subject to such exemptions as provided by law.

A transient guest tax is hereby levied in the city, at the rate of four percent (4%) upon the gross rental receipts derived from or paid by transient guests for lodging or sleeping accommodations, exclusive of charges for incidental services or facilities, in any hotel or motel.

(a)   There is hereby created under the authority of the Act, a municipal corporation to be known as the City of Stafford, Kansas Public Building Commission (the “PBC”).

(b)   The PBC shall be composed of six (6) members (the “Members”).  Each Councilmember and the Mayor shall appoint one Member to the PBC; such Members shall serve at the pleasure of and only during the term of the person that appoints such Member.  In the event that the PBC provides buildings or structures that are leased to governmental entities other than the City, the composition of the PBC shall be modified by subsequent ordinance of the City to conform to the requirements of the Act.

(c)   The PBC is created for the purposes of, and shall have the powers and shall perform the functions set forth in, the Act; provided that the PBC shall not enter into any leases for PBC property to entities other than the City without the prior approval of the governing body of the City.  The City, by ordinance or charter ordinance hereafter taking effect, shall have the authority to further limit or expand the purposes, powers and/or functions of the PBC.

(d)   Unless otherwise approved by the governing body, the City Clerk shall provide administrative services to the PBC and the City’s bond counsel and City Attorney shall provide legal services to the PBC.

(e)   The PBC shall have the authority to adopt bylaws, resolutions or other official actions authorized by the Act and not inconsistent with the provisions of this Ordinance to govern its actions.

The levy of the one percent (1%) Sales Tax is hereby authorized in order to finance the costs of constructing, equipping, operating, and maintaining a new swimming pool and related appurtenances, and to finance other general operating, recreational and capital improvement expenses of the City.  In accordance with K.S.A. 12-191, collection of the Sales Tax shall commence April 1, 2017, or as soon thereafter as permitted by law.
