The owner of any building or other structure to be demolished or removed from its location shall comply with the pertinent provisions of the building code and shall apply for a demolition permit and shall pay a permit fee of $10. The permit shall include both the street address and legal description of the tract on which the building or structure is located.

A permit shall not be required for any building less than 100 square feet.

It shall be the duty of any person at the time of making application for a permit as provided in this article, to give a good and sufficient surety bond to the city, to be approved by the governing body, indemnifying the city against any loss or damage resulting from the failure of any such person to comply with the provisions of this article or for any damage or injury caused in removing any such house or structure. The bond herein shall be in the sum of $5,000, or cash may be deposited in lieu of such surety bond.

A public liability insurance policy issued by an insurance company authorized to do business in the State of Kansas, in the amount of $100,000 per person, $300,000 per accident as to personal injury, and $50,000 property damage may be permitted in lieu of a bond.

There shall be no delinquent real estate taxes on the subject tract. The city clerk shall verify this fact with the county treasurer upon receipt of the permit application.

The application for the permit shall be submitted to the city clerk. The application for the permit shall be placed on the agenda of the next regularly scheduled meeting of the governing body for the governing body’s first consideration. The governing body shall have 30 days in which to grant or deny the permit. If the building inspector and city superintendent, after viewing the site and reviewing the application, determine that there is no need for the waiting period, the application for a demolition permit may be advanced and the waiting period waived. The requirements of this section shall not apply to demolition of a structure pursuant to the dangerous structures article of the code of the city.

Upon removing the structure, the owner shall seal the sanitary sewer connections as provided by the city code. In addition, the owner shall fill any basement or other excavation located upon the premises and take such other action necessary to leave the premises in a safe condition.

(a) In the event that a building is demolished and a demolition permit is not acquired pursuant to this article, the owner of the structure and person or persons demolishing this structure, if they are separate people, shall be in violation of this article.
(b) Anyone found violating any section of this article shall be cited to appear in the municipal court of the city and shall be fined not more than $500 and/or sentenced to serve a term not greater than six months in jail.
