A CHARTER ORDINANCE EXEMPTING THE CITY OF STAFFORD, KANSAS, FROM SECTION 12-4100 AND SECTION 12-4112 OF THE KANSAS STATUTES ANNOTATED AS ADOPTED BY THE LEGISLATURE OF KANSAS IN THE SESSION LAWS OF 1973, CHAPTER 61; AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT AUTHORIZING THE ASSESSMENT OF COURT COSTS IN CASES HEARD IN THE MUNICIPAL COURT OF THE CITY OF STAFFORD, KANSAS, AND PRESCRIBING CONDITIONS UNDER WHICH THE CITY ATIORNEY SHALL PROSECUTE CASES HEAD BY THE MUNICIPAL COURT OF THE CITY OF STAFFORD , KANSAS.

Section 1. The City of Stafford, Kansas, a city of the third class by the power vested in it by Article 12, Section 5, of the constitution of the State of Kansas, hereby elects to exempt, and does exempt itself from and makes inapplicable to it, section 12-4110 and Section 4112 of the Kansas Statutes Annotated as adopted by the legislature of Kansas in Session Laws of 1973, Chapter 61, which are not uniformly applicable to all cities, the legislature having made special provisions applying to certain classes of cities in said enactment.

Section 2. In lieu of K.S.A. 12-4110, the governing body of the City of Stafford, Kansas, hereby enacts the following provision:

       The city attorney, in person or by his assistants shall prosecute all contested cases in municipal court, and shall appear to prosecute such other cases as the judge of the municipal court shall deem necessary.

Section 3. In lieu of K.S.A 12-4112, the governing body of the City of Stafford, Kansas, hereby adopts the following provision:

       Each person found guilty of a violation of the ordinances of the City of Stafford, Kansas, shall be assessed costs for the administration of justice in the municipal court of the City of Stafford, Kansas, and such costs shall be determined by ordinance.
