A Charter Ordinance Exempting the City of Stafford, Kansas from the Requirements of K.S.A. 15-204.

Whereas the City of Stafford is a Third Class City and is subject to the laws set forth in K.S.A. 15-204 which concerns the appointment of certain city officials by the Mayor with the approval of the City Council,

And Whereas the City of Stafford desires to exempt itself from requirements of making an annual appointment of city officials and desires to substitute the following charter ordinance in its place covering the appointment of certain city officials.

Now therefore be it ordained by the governing body of the City of Stafford by this Charter Ordinance that the following be enacted:

l.          The City of Stafford shall be and is here exempted from the provisions of K.S.A. 15-204 upon the approval, publication, and passage of the applicable protest petition period.

2.         The following shall govern the appointment of certain city officials for the City of Stafford, Kansas:

       The Mayor, with the consent of Council, may appoint at the first regular meeting of the Governing body in May of 2008 and in every other year thereafter so that the appointment is one full year following the election which chooses the Mayor or City Council members, the following city officers: A municipal judge, public health officer, and the city attorney.  The municipal judge, public health officer and city attorney shall hold the office for an initial term of two years and until their successors are appointed.  Any of these officers who are reappointed shall hold their offices for an additional two year term and until their successors are appointed and qualified.   The duties of the offices shall be regulated by ordinance.  Any officer may be removed by a majority vote of the total Membership elected or appointed to the council and may be suspended at any time by the mayor. All other city officials shall not be considered as appointed positions.
